Terms & Conditions and Waiver of Liability

I have read and agree to the club’s Terms, Conditions, and Waiver of Liability as described below:

South Eastern Speedskaters – Participant Terms & Conditions and Waiver

(Applies to all participants, including trial skaters and members.)

By checking the checkbox on the membership form, you confirm that you have read, understood and agree to these Terms & Conditions and Waiver.

1 Participation and Status

You acknowledge that you are participating in inline speedskating sessions conducted by South Eastern Speedskaters Inc. (the “Club”) and that participation may be as a trial participant, guest skater or financial member.

In these terms, “speedskating sessions” means any activity organised, operated, or sanctioned by the Club, including but not limited to classes, training sessions, races, demonstrations, social or fundraising events, off-skate fitness activities, and participation in events at other venues under the Club’s direction.

You understand that full membership (including registration with Skate Australia Victoria Speed (“SAVS”)) is required for ongoing participation and to access that governing body’s insurance coverage.

If you participate without current membership of SAVS, you acknowledge that you do not have the benefit of that insurance and participate entirely at your own risk.

2 Assumption of Risk

You understand that inline speed skating involves inherent risks, including but not limited to falls, collisions, equipment failure, surface conditions, and physical strain, which can result in injury or death.

You voluntarily assume all risks and responsibility associated with participation.

3 Release and Waiver of Liability

To the fullest extent permitted by law, you:

Release and discharge the Club and its officers, coaches, volunteers and agents from any and all claims, actions or demands for injury (including death) or damage to property arising out of participation; and

Agree not to bring any claim against the Club or its representatives for such injury or damage, except where caused by their reckless or intentional misconduct.

Acknowledge that nothing in this agreement limits your rights under Australian Consumer Law to the extent they cannot lawfully be excluded.

4 Safety and Conduct

You agree to:

Wear a helmet and other protective gear as required by the Club.

Follow all instructions of coaches, officials, and club representatives and adhere to safety rules at the venue.

Not participate if you are unwell or under the influence of drugs or alcohol.

Accept that the Club may refuse or cancel your participation if you breach safety requirements or behave in a manner that risks injury to yourself or others.

5 Medical Declaration and Consent

You declare that you are physically fit and free from any condition that would make participation unsafe.

You consent to the Club providing first aid and/or obtaining emergency medical treatment (including ambulance services) if required, and agree to pay any associated costs.

6 Parent or Guardian Consent (for Participants under 18)

If the participant is under 18, the parent or guardian providing consent confirms that they have read and understood these terms and agree to them on behalf of the child.

7 Photography and Promotion

You consent to the Club taking photos or videos during sessions for training or promotional purposes, unless you notify the Club in writing at info@sespeed.au that you do not consent.

8 Governing Law

These terms are governed by the laws of Victoria, Australia, and any dispute is subject to the exclusive jurisdiction of its courts.

9 Acknowledgement

By checking the checkbox on the membership form you acknowledge that you have:

Read and understood these Terms and Conditions and Waiver;

Agreed to them voluntarily; and

Accepted all associated risks of participation in Club activities.
